Terms of Service.

The terms that apply to using our website and working with digitally scaled.

Agreement to terms

By using this website or engaging digitally scaled for services, you agree to the terms outlined here. These terms apply to general use of our website; specific client engagements are further governed by individual project agreements or statements of work.

Services

digitally scaled provides web, software, and AI development services along with related digital marketing and design work. The specific scope, timeline, and deliverables for any engagement are defined in a separate written agreement between us and the client.

Client responsibilities

Clients are responsible for providing timely feedback, necessary access, and accurate information required for us to genuinely deliver the agreed-upon work. Project timelines are dependent on this collaboration happening in a reasonably timely manner.

Intellectual property

Unless otherwise specified in a project agreement, ownership of custom deliverables transfers to the client upon full payment. We retain the right to showcase completed work in our own portfolio unless a client specifically requests otherwise.

Payment terms

Payment terms, including deposits, milestones, and due dates, are defined in individual project agreements. Late payment may affect project timelines and ongoing support arrangements.

Limitation of liability

While we take genuine care in our work, digitally scaled is not liable for indirect, incidental, or consequential damages arising from use of our website or services, to the extent permitted by applicable law.

Changes to these terms

We may update these terms from time to time. Continued use of our website after changes are posted constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of the state in which digitally scaled operates, without regard to conflict of law principles.
